Surety Bond; Purpose

 

 

 

An action of replevin, which is also known as a writ of attachment, occurs in a civil litigation proceeding.  By order of the presiding court, a Plaintiff is permitted to seize and take possession of the disputed property of the Defendant, prior to a final judgment being given in the underlying case. 

A condition for the replevin action is that the court-ordered surety bond amount be obtained by the Plaintiff.

Although it is the Plaintiff who obtains this bond, its benefit is for the Defendant in case the court subsequently determines that the replevin action was wrongly ordered.  The bond, in such a determination, would ensure the timely return of the property, and/or to compensate the Defendant for the harm caused by a wrongly issued replevin. 

 

 

 

Qualifying and the Premium 

 

 

 

Our agency offers you the Utah replevin bond in the amount that the court requires of you.  Up to a $100,000 surety bond requirement, we also do so without a credit check inquiry.

If you require a replevin/writ of attachment bond greater than $100,000, approval is determined on the basis of good credit, as determined by a surety underwriter who will review your application. 

For any Utah replevin surety bond, our agency will need the following from you:

  • A copy of the court order or the court minutes stating that a replevin surety bond is required;
  • A completed surety bond application which can be sent to you via DocuSign;
  • Review of your application, subject in part, to the dollar amount of surety required as discussed above;
  • Upon approval of your surety bond application, payment of the first annual premium.

We issue your replevin surety bond and a Power of Attorney form once your premium has been paid.  Upon receipt by mail, you’ll sign your bond and file it with the presiding court.

 

 

 

Annual Renewal of the Premium

 

 

 

The premium associated with your Utah replevin/writ of attachment bond will renew annually for as long as the court requires surety.

Premiums are completely non-refundable.
