Vermont Writ of Attachment/Replevin Bond; Amount and Purpose
An action of replevin occurs in a civil litigation proceeding. The court permits the Plaintiff to seize the disputed property of a Defendant, prior to a final judgment in the underlying case.
A condition for the replevin to take place is that you obtain a surety bond in the amount ordered by the court.
In Vermont, pursuant to to Title 12, Chapter 183, § 5373, as amended, the amount of the surety bond required should be twice the value of the property which is being replevined.
While required of you as Plaintiff (or, for legal counsel, your client), the purpose of the bond is to protect the Defendant from any loss or harm caused if the court subsequently determines that the replevin action was wrongly issued.
Qualifying and the Premium
Our agency qualifies you for the Vermont replevin bond up to a $100,000 surety bond requirement without a credit check inquiry.
If you require surety greater than $100,000, approval is granted after review of your submitted surety bond application. Additionally, good credit for these higher amounts will absolutely be required.
For any Vermont replevin/writ of attachment bond in any amount, our agency will need the following from you:
- A copy of the Vermont court order or court minutes stating that a replevin surety bond is required;
- A completed surety bond application. The application can be sent to you via DocuSign;
- Review of your application;
- Upon approval of your surety bond request, payment of the first annual premium.
Your replevin surety bond is issued to you immediately upon payment of the premium. Your bond is sent to you along with a Power of Attorney form.
Upon receipt by mail, you will sign and file your surety bond and POA form to the presiding court.
Annual Renewal of the Premium
The premium for your Vermont replevin bond renews annually, on the anniversary of your bond’s issuance, for as long as the court requires surety.
Premiums paid are earned in full, and are non-refundable, in part and entirely.
