Surety Bond; Amount and Purpose



The surety bond required of a Washington personal representative, may alternately be referred to as a surety bond of an “executor” or an “administrator” of a decedent’s estate.

When required pursuant to Washington statute, as may be amended, the amount of the surety bond will be according to whatever the court directs.

As an agency, we typically see amounts issued that are the equivalent to the value of the personal estate, and potentially any income the estate may earn; however, again, that amount will be determined by the presiding probate court.  Ultimately, you'll go with whatever the court orders.

The personal representative bond is a financial guarantee of your compliance with all Washington state laws in the administration of the decedent’s estate.



Qualifying and the Premium



Our agency offers you the Washington personal representative bond in any amount (minimums will apply).  Up to a $250,000 surety bond requirement, we also do so without a credit check inquiry.

Amounts greater than $250,000 are subject to underwriter approval, the determination of good credit, and providing any additional documentation or information requested.

For any personal representative bond, our agency will need the following from you:

  • A copy of the state of Washington court order appointing you personal representative, executor, or administrator, and which states the amount of surety bond required;
  • A completed surety bond application.  In most cases, the application may be completed via Docusign.  This will allow you to complete, sign, and return your application to our agency electronically;
  • Upon approval of your surety bond, payment of the first annual premium.


Issuing Your Bond 



Our agency issues your personal representative surety bond and a Power of Attorney form immediately upon payment of the first annual premium.

These items are then mailed to you.  It will be your responsibility (or that of legal counsel) to file the completed documents with the presiding Washington probate court.  You will sign your bond as Principal before filing.


Annual Renewal of the Premium


The premium associated with your bond renews annually on the anniversary of your bond’s issuance for as long as the court requires surety.

Premium paid are earned in full, and are non-refundable both in whole or in part.
