Surety Bond; Amount And Purpose


The bond required of you as a condition of your appointment as “personal representative” over a decedent’s estate in West Virginia may also be alternately referred to as a surety bond of an administrator or an executor.

According to West Virginia statutes, as amended, the amount of the surety bond will be, at least, the full value of the personal estate which you’ll administer.

The purpose of the surety bond is to serve as a financial guarantee which secures your compliance with all West Virginia laws, as also the protection of the rights of any heirs and/or creditors of the estate.



Qualifying and the Premium



Our agency typically approves applications for a West Virginia personal representative bond up to a $250,000 surety bond requirement without a credit check.  Minimums may apply.

Amounts greater than $250,000 are subject to a further underwriter review of your application.  This review will include a credit.  To be approved at these higher amounts, good credit, and sometimes additional criteria, are required.

For any West Virginia personal representative, executor, or administrator bond, our agency will need the following from you:

  • A copy of the court order stating that a surety bond is required and which also appoints you as personal representative (or any other designation, over the estate);
  • A completed surety bond application.  The application is usually provided to you via DocuSign.  Completing the application via Docusign allows you to electronically complete, sign, and return it for further review;
  • Upon approval, payment of the first annual premium.


Issuing Your Probate Surety Bond



Your W. Virginia personal representative bond and a Power of Attorney form are issued to you immediately upon payment of the premium.

These will be sent to you for signing by (your surety bond).  You will file both documents. Our agency does not need a copy of the signed surety bond.


Annual Renewal of the Premium


The premium associated with your West Virginia personal representative bond renews annually on the anniversary of your bond’s issuance for as long as the court requires surety.

Premiums paid are earned in full which means no refunds, either in full or in part, are offered.
