Surety Bond; Purpose and Amount


As a condition of your court-appointment as a Wisconsin personal representative, executor, or administrator of a decedent’s estate, the presiding probate court may require you to furnish a surety bond.

Your surety bond serves as a financial guarantee of your compliance with all Wisconsin laws.  The bond also serves as a protection for any creditors or heirs of the estate which you’ll administer.

The surety bond required will be set by the presiding court and is likely to be in at least an amount commiserate with the value of the personal property of the estate.

Qualifying and the Premium


Our agency offers you the Wisconsin personal representative bond in any amount (minimums do apply).  Up to a $250,000 surety bond requirement, we also typically do so without a credit check inquiry.

If you require a personal representative surety bond greater than $250,000, you should expect that your application will be carefully reviewed by a surety bond underwriter.  This review will include a credit check inquiry, where good credit will be required for approval.

Additionally, for amounts greater than $250,000, you may also be asked to supply supporting information and documentation as a condition of approval.

For any personal representative/administrator/executor surety bond in Wisconsin, our agency will need the following:

  • A copy of the Wisconsin court order stating that a surety bond is required and which also appoints you personal representative;
  • Completing a surety bond application.  Usually, we’ll provide the application to you via DocuSign.  This will allow you to sign, complete, and return the application to our agency electronically;
  • Upon approval of your surety bond application, payment of the first annual premium.


Issuing Your Surety Bond


Our agency issues your surety bond and a Power of Attorney form to you upon payment of the first annual premium.

It will be your responsibility to file your completed surety bond, along with the POA form, to the presiding probate court, after signing your bond as Principal.

Our agency does not need a copy of your signed surety bond.


Annual Renewal of the Premium


The premium associated with your personal representative bond will renew annually on the anniversary of your bond’s issuance.  This occurs for as long as the court requires your surety bond.

In this regard, premiums paid are earned in full and are nonrefundable either in whole or in part.
