What is a Probate Bond?




In short, a probate bond is a surety bond that is required to ensure that the executor of an estate will comply with the wishes of the deceased.

The bond is issued to ensure that the trustee will not mismanage the property or items in the estate or wrongly spend any monies in the estate.




Who Requires a Probate Bond?




A probate bond can be requested by those who will have an inheritance from an estate once the estate is fully settled.

Such persons want to ensure that upon settlement of the estate, funds or any property will be rightly and fully transferred to the heirs as instructed in the will. The heirs are essentially protecting themselves from any possible malfeasance on the part of the will executor.

Probate bonds may also be required by a probate court.

In either case, a probate bond when requested is not an option; it must be purchased in order for the probate proceedings to continue.




How much will a probate bond cost?



Update (June 2019):  We now offer the California probate surety bond, up to $100,000, with no credit inquiry.  For California, and all 50 states, probate surety bonds up to this amount are “instant issue” surety bonds.  

The cost of a probate bond will depend on several factors:

One, is the amount underlying value of the estate.  The probate bond is issued for the estate’s total value.

The second cost is the principal’s financials.  The principal is the person who is required to purchase the probate bond.

Finally, the credit report and score of the principal is a determining factor in the premium amount required to have this bond issued.

Applicants with good credit and financials may only pay a small percentage of the probate surety bond.
