Illinois Notaries

Illinois notaries are engaged in the profession of witnessing signatures in the attempt to prevent and deter fraud.

Essentially, your job is as simple as that. There is more involved, of course, but that’s basically it.

In Illinois, notaries are required to obtain a $5,000 surety bond which lasts the length of your commission. The commission granted by the Office of the Secretary of State is for 4 years.

The Illinois notary bond is just a one time fee of $50.

 

 

 

Illinois Notary Bond: The Purpose

The Illinois notary bond is a financial guarantee, a surety, which protects your customers, the people of the state of Illinois, from acts of fraud, forgery, and other acts of criminal malfeasance that a notary may commit in the performance of notarial acts.

A common misconception is that your notary bond protects you. It does not at all.

Your notary bond is exclusively for the protection of your customers.

Should a claim be paid by the surety on your notary bond for harm done to an Illinois consumer, you would be legally obligated to reimburse the surety for all costs and fees paid in the resolution of that claim.

Whereas your surety bond protects others, an Errors and Omissions insurance policy is for your protection; however, this is not required by the state to become a notary.

 

 

 

Obtaining An Illinois Notary Bond:

Becoming a Notary Public in Illinois

 

 

 

To become a notary public in Illinois, you need to either be a resident of Illinois or a bordering state.

You will also need to:

  • Be at least 18 years old;
  • Complete an Illinois notary application and pay a $10 application fee made payable to the Illinois Secretary of State;
  • Not have any felony convictions;
  • Have your application notarized by an existing notary;

And submit the surety bond along with the application to the Secretary of State.

Please note: The name that you want commissioned on the notary with the Illinois Secretary of State and the name you want on the surety bond should match exactly.
