Licensing – Surety Bond and Purpose
The Colorado Division of Minerals and Geology requires entities who are engaged in mineral mining reclamation, and who wish to do so in Colorado, to obtain a surety bond in an amount to be determined by the Division.
According to Title 34 – Mineral Resources, the purpose of the surety bond is to serve as a “financial warranty”. This warranty includes offering a financial guarantee that any relevant attorney fees and other costs may be recovered by the Division, if required.
But more than that, the surety bond is also a financial pledge of your compliance with all relevant provisions of the Colorado Mined Land Reclamation Act, as amended.
Qualifying and the Premium
Applicants for the Colorado mining financial warranty bond will provide our agency with the surety bond amount required.
Additionally, the underwriting of your bond includes a short, signed surety bond application and a review by our underwriters.
To be approved for this bond through our agency, good credit is required; we will not be able to get you approved otherwise. The premium, upon approval, will be 2% of the financial warranty bond amount.
Turnaround times for a decision typically take a few hours, depending on when the application is submitted. If the bond amount is especially large, you may be asked to provide a financial statement; however, this is usually not the case.
Upon approval of your surety bond, our agency issues it to you immediately after payment of the premium, along with a Power of Attorney (POA) form.
Your original surety bond is signed by you as Principal, and then filed along with the POA form to:
