The Florida process server bond is a $5,000 surety bond required by the Florida county in which a process server conducts business.

Process servers are regulated by Chapter 48, Process and Service of Process of the Florida State Statutes.

Florida Process Server Bond: The Purpose




The first thing that you as a Florida process server should understand is that the required $5,000 surety bond does not protect you at all.

Rather, this surety bond protects others from violations of Chapter 48, fraud, criminal malfeasance or misconduct that you might commit in the performance of your process server duties.

The bond further protects others from acts of neglect or sheer incompetence on the part of a process server, and gives those persons the right to file against a the surety bond.

Of note is that any claims paid on a surety must, by law, be fully reimbursed by the licensed process server. Surety bonds are not the same, nor are they treated the same as insurance policies.




 Cost and Duration




The cost of your process server bond is just $100. By law, you will be required to renew your surety bond on an annual basis.




Becoming a Florida Process Server




If this is your first time registering as a process server in Florida, you will need to:

  • Be at least 18 years old;
  • Be a permanent resident of Florida (i.e. not a “snowbird”);
  • Be of sound mind;
  • Pass a written test on Chapter 48 of the Florida Statutes;
  • Complete a Florida process server application;
  • Pay a nonrefundable $300 application fee;
  • Obtain and pass a  criminal background check;
  • Obtain a certificate of “good conduct”;
  • Purchase the $5,000 Florida process server surety bond.
