Florida telemarketing companies are regulated by Sections 501.601 – 501.626 of the Florida Statutes, and Chapter 5j-6 of the Florida Administrative Code. Florida telemarketers also come under the direct jurisdiction of the Florida Department of Agriculture and Consumer Services (FDACS).
The Department and the Florida Telemarketing Act describe telephone marketers as those who traffic in the sale of goods or services by phone.
In addition to the above, the law requires a Florida telemarketing individual or company to file a $50,000 surety bond with the FDACS.
You are automatically approved for the Florida telemarketing surety bond. This is because after completion of a short surety bond application --- which we'll take from you over the phone --- and payment of the $500 premium, this bond is issued to you immediately.

After the bond's issuance, a copy of the bond can be emailed to you. The original surety bond, which you will sign as Principal, will be sent to you by the following business day. It is ideally the original surety bond that you will want to file for compliance.
At $500 premium, this surety bond is issued to you for one year. The bond will therefore renew on the anniversary of its issuance for another $500. Our agency also offers you the option to prepay this bond for up to 3 years. Prepayment of your premium benefits you in two ways: One, you renew less frequently; and two, you save over renewing each year.

The purpose of the $50,000 Florida telemarketing bond is to protect consumers, or customers, from any acts of fraud, theft, misrepresentation and other criminal conduct committed in connection with duties as a Florida telemarketer.
The misconduct extends to wrongful acts committed by a licensed telemarketing company, its employees, agents, managers, and owners.
Of note, this surety bond is exclusively for the financial protection of others. To that end, it is not insurance which protects the telemarketing company.
The bond is also a prerequisite for licensing by the Department.
