By way of background, the Iowa home improvement contractor bond requirement was precipitated by persistent allegations of fraud by contractors; in fact, such accusations constitute the state’s number one fraud complaint.

The bond is therefore a financial guarantee for the people of the state of Iowa — your clients and customers —- which protects them from breach of contract, embezzlement, fraud, theft, willful negligence, criminal malfeasance and misfeasance that a home improvement contractor may commit in the course of contracting obligations.

The bond also protects against contractors who fail to obtain the required permits, or fail to pay subcontractors.

Such protections afforded by means of this bond also extend to wrongful acts committed by employees, agents, and managers of a licensed and bonded contractor, and which also results in some credible harm.

While the bond protects the people of the state of Iowa and is required of you, to be clear, it is not an insurance policy.

In the present instance, this means that as principal of this surety bond, you shoulder the responsibility for all claims paid against your bond. Were a claim to be paid against your bond, you must therefore repay the surety for all costs and fees involved.

In no instances however, will the surety pay above the sum of $75,000 as an aggregate total.
