Surety Bond; Amount and Purpose

Gaming establishments in Mississippi may elect to furnish evidence of financial responsibility by procurement of a surety bond — either by itself — or in combination with an irrevocable letter of credit (ILOC).

ILOC’s are supplied by a banking institution.

Assuming only the issuance of a surety bond, the amount required is equivalent to the total account balances of the fantasy contest players. The purpose of the surety bond requirement is to serve as a financial guarantee which protects the players’ monies. (HB Section 9, 97-33-303, as amended).

Qualifying and the Premium

Our agency offers you the Mississippi gaming establishment bond in the amount required of your business. Additionally, applicants who have a requirement up to $25,000 will be automatically approved as there is no underwriter review or credit check inquiry.

Candidates for a surety bond greater than $25,000 require both an underwriter review and credit check review.

Regardless of the surety bond amount, our agency will require the following from you:

  • A completed, signed and witnessed surety bond application. The application is short, and we will go over what’s needed with you;
  • If the bond required is greater than $25,000, submission of the application and review by an underwriter. The review process will include a credit check inquiry. To be approved, good credit will be required.
  • Payment of the first annual premium.

Upon approval of your Mississippi gaming surety bond and payment of the, the bond is issued to you along with a Power of Attorney form.

We will sign you bond as Surety; and upon receipt, you’ll sign your bond as Principal.

You will then need to file your surety bond and POA form to the following address:

Mississippi Department of Revenue

P.O. Box 139

Jackson, MS 39205
