North Dakota Franchise Registration

North Dakota franchises are licensed and governed by the North Dakota Securities Department. Whether or not you are required to obtain a surety bond is determined by the Commissioner (presumably, you do require a surety bond which is why you’re here).

The amount of the bond required is an amount determined by the Commissioner. When you call us, we’ll need you to provide us with that amount as it’s not pre-established.

We’ll also need you to provide us with the name and address of who is requiring your surety bond. In insurance lingo, this is referred to as the obligee.

Qualifying and The Premium

We provide the North Dakota franchise bond in whatever amount is required.

But up to a $50,000 surety bond amount, there is no credit check, and the premium is just 1%, or $100, whichever amount is greater.

Amounts greater than $50,000 do require a credit check, and approval is contingent upon good credit. The application for these larger amounts also needs to be signed. The rate remains 1%

When you call us, this is what we’ll need:

  • The name, exactly as it should appear on your surety bond, along with the address, phone number, and email address;
  • The name and address of the obligee. A phone number for the obligee will also be requested. The obligee is why you’re obtaining a surety bond, as they require it of you. This is also the location where you’ll mail your bond upon receipt in the mail;
  • The location of your franchise.

After approval of your bond and payment of the premium, our agency issues your bond, along with a Power of Attorney form.

Upon receipt, you’ll sign your bond as Principal and file it with the obligee at their address.

Purpose of Your Franchise Surety Bond Requirement

Your surety bond is required in accordance with 51-19-07 of North Dakota’s legislative code for those whom the Commissioner requires surety.
