Transient merchants are defined by the North Dakota Attorney General as those who are performing temporary work, transient, in the state whether it be in one or multiple locations.
If this is applicable to you, you are required to obtain a license and a surety bond.
The North Dakota Attorney General number to call to determine the surety bond amount you are required to obtain is 701-328-2329. After calling this number, then you should contact a surety agency.
Qualifying for the North Dakota merchant bond includes completing a surety bond application --- which we can begin with you over the phone. However, you will need to sign and have witnessed your application.
An underwriter review and a credit check are also required. To be approved through our agency, good credit is required.
The approval rate is at 1% of the amount of surety required, or $100, whichever amount is greater.
Upon approval of your surety bond and payment of the premium, your surety bond and a Power of Attorney (POA) form will be mailed to you.
Upon receipt, you’ll sign your original bond as Principal (copies are not acceptable), and file it with the POA to:

Your surety bond is active for one year from the date of issuance. The bond and the premium will renew thereafter.

Your bond is a financial guarantee of your compliance with Chapter 51-04 of the North Dakota Century Code as amended.
Other guarantees of your surety bond are that you’ll honor all warranties and representations; and that you’ll comply with all written and oral statements made. The same is likewise true of any employees of yours.
