Registration and licensing of South Dakota investment advisers are handled by the state’s Division of Insurance.
Investment advisers (IA’s) must be able to demonstrate capital requirements. If you are an IA who will have discretion over your clients’ accounts, but not custody, you’ll need to demonstrate a minimum net worth of at least $10,000.
If you are an IA who has custody over your clients’ accounts, then you’ll need to be able to demonstrate a minimum net worth of $35,000.
The demonstration requirement is for licensing, not for purposes of obtaining your surety bond.
No set amount for the South Dakota investment adviser bond is established. The amount of surety will be determined by the Division of Insurance.
When you call us, you’ll tell us the amount of surety bond that you require. We’ll take the application directly from you over the phone. As part of the underwriting process, a credit inquiry is required.
To be approved for the investment adviser bond through our agency, it will be required that you have good credit.
Upon approval through our agency, the premium will be 1.5% of the bond amount required.
Once the premium is paid, your surety bond is issued to you and mailed by the following business day. Overnight delivery of your bond is available for an additional fee.
The South Dakota investment adviser bond is issued for a one-year period. Thereafter your surety bond and the premium renew.
Your bond form is Form U-SB, the Uniform Surety Bond Form. It is a general bond form which can be used nationwide. Its purpose is to serve as a financial guarantee for the state of South Dakota and any consumers, that you will act as an IA in accordance with all rules and regulations.
