Surety Bond Requirement and Purpose
Texas gasoline, diesel fuel, and dyed diesel fuel businesses are required by the state’s Comptroller of Public Accounts to post a surety bond as a condition of conducting business.
The surety bond requirement is a financial guarantee for the Lone Star State that all fuel taxes owed will be paid as required.
The surety bond is required of suppliers, permissive suppliers, importers/exporters, distributors, and fuel dealers of the above groups according to the following formula:
- A MINIMUM surety bond amount of $30,000;
- Or the greater of 2x the amount of tax that could be due on tax-free fuel acquired, purchased, or sold within a reporting period;
- With a MAXIMUM surety bond amount of $600,000.
Qualifying and the Premium
Applicants for the Texas motor fuels tax continuous bond will be required to complete an application and undergo an underwriter review.
Our agency can begin the application with you by phone (and we would encourage it); however, your application will need to be signed by you before submission.
The review process includes a credit check inquiry. Good credit is required for approval by our Surety; and the rate is 1% of your bond amount annually.
Upon approval of your surety bond and payment of the premium, our agency issues your bond to you immediately. It is the original surety bond that you’ll file, not an email copy.
Upon receipt of your surety bond and Power of Attorney form, you’ll file both documents to:

Term Of Your Surety Bond
This surety bond is issued for a period of one year. It is called “continuous” because it will always be required, and will renew at whatever amount you require at the end of that term.
