Surety Bond; Amount and Purpose
An Alabama attachment order occurs during a civil litigation case .During the proceeding, the court allows you as Plaintiff (or for legal counsel, your Plaintiff-client) to seize the disputed assets or property of the Defendant, prejudgment; that is, before the final disposition of your underlying case.
According to state statutes, you as Plaintiff are required to obtain an attachment surety bond in order for the attachment order to take effect.
Section § 6-6-45 of the Alabama Code, as amended, stipulates that when a surety bond is required, it must be twice the amount of the value of the attachment.
While required of you as Plaintiff, the surety bond serves as a financial guarantee for the adverse party (i.e. the Defendant) that you will prosecute your effectively; and that, moreover, you will pay the adverse party for any harm caused by a (subsequently-determined) wrongful attachment order.
Qualifying and the Premium
Our agency offers you the Alabama attachment bond up to a $100,000 surety bond requirement without a credit check.
An amount greater than $100,000 is subject to a further underwriter review of your application. This review includes a credit check inquiry. To be approved for an Alabama attachment bond through our agency for these higher amounts, good credit will be required.
But for any AL attachment order, our agency will need the following from you:
- A copy of the Alabama court order stating that an attachment surety bond is required. In lieu of a court order, a letter from retained legal counsel will suffice; however, such a letter must substantially include all of the information that a court order typically provides;
- A completed application from you. This application is sent to you via Docusign. Docusign will allow you to sign, complete, and return your application electronically;
- Review of your completed application according to, in part, the dollar amount of your attachment bond requirement;
- Upon approval, payment of the premium
Issuing Your Bond
Your Alabama attachment bond and a Power of Attorney are issued to you upon approval and payment of the premium.
These items are then mailed to you for signing as the bond’s Principal. It is your responsibility to see that your attachment bond is filed with the Alabama court; our agency does not need a copy of your signed surety bond.
Annual Renewal of the Premium
The premium for your Alabama attachment surety bond is subject to annual renewals for as long as the court requires surety.
Premiums paid are earned in full and are not subject to refunds.
