Surety Bond; Amount and Purpose
As Plaintiff (or legal counsel for Plaintiff) in a civil litigation proceeding, an Alabama court may have decided that, prejudgment, you may garnish the wages, accounts, or assets of the Defendant party. The garnished assets, in turn, are held by a third party.
A prejudgment such as this is predicated on the apparent strength of your case.
A condition of the garnishment order taking effect is that you obtain a surety bond. Alabama law indicates that the garnishment surety bond should be double the amount of the assets claimed in the action.
While required of you, the garnishment surety bond serves as a financial guarantee for the Defendant that protects this adverse party from the wrongful or “vexatious”prosecution of your case, as determined by the court.
Qualifying and the Premium
Our agency offers you the Alabama garnishment bond in the amount required. Up to a $100,000 surety bond requirement, we also do so without a credit check inquiry.
An Alabama garnishment surety bond requirement greater than $100,000 is subject to further review of your application by a surety bond underwriter. This review will include a credit inquiry.
Approval for a garnishment surety bond amount greater than $100,000 requires good credit as determined by the surety underwriter.
For any garnishment surety bond, our agency will need the following from you:
- A copy of the court order, or, in lieu of the same, a letter from your legal counsel stating that a garnishment surety bond is required. In instances where an attorney provides a letter, all of the information which would is included on a standard court order is also requested;
- A completion of an application by you. The application can be sent to you via Docusign. This will allow you to complete, sign, and return your application to our agency electronically;
- Review of your completed application according to, in part, the amount required of you.
- Upon approval, payment of the first annual premium
Issuing Your Garnishment Bond; Filing with the Court is Your Responsibility
Our agency issues your AL garnishment bond, along with a Power of Attorney immediately upon payment of the premium.
Your surety bond and POA form are then mailed to you for signing. It will be your duty to see that your garnishment bond and POA are filed in a timely manner by the court. Our agency does not need a copy of your filed surety bond.
Annual Renewal of the Premium
Your garnishment bond is subject to annual renewals of the premium for as long as the presiding civil court requires surety.
Please plan to pay your premium at least twice.
Premiums paid are earned in full.
