Surety Bond: Purpose And Amount
An attachment order allows you, as Plaintiff, to seize the disputed property or assets of the Defendant. The order takes place before the final disposition of your case, but is conditioned upon you obtaining a surety bond in the amount that the court orders.
Arkansas Code, Section 16-110-107, as amended mandates the surety bond requirement. The court will likely determine the amount of the surety bond required of you.
Your attachment surety bond serves as a financial guarantee for the adverse party, that is the Plaintiff, in case the court subsequently determines that the attachment order was wrongfully issued.
In such a determination, the Defendant is guaranteed compensation for any harm caused, up to the surety bond amount.
Qualifying and the Premium
Our agency offers you the Arkansas attachment bond in the amount that the court has ordered of you. Up to a $100,000 surety bond requirement, we also do so without a credit check inquiry.
An attachment surety bond requirement greater than $100,000 is subject to a further review of your application by a surety bond underwriter. This review will include a credit check inquiry. To be approved at an amount greater than $100,000, good credit will be required.
For any attachment surety bond request, our agency will need the following from you:
- A copy of the Arkansas court order which states that an attachment surety bond is required. In lieu of the court order, a letter from legal counsel which has substantially the same information as to be found on a court order;
- A completed surety bond application. To facilitate ease of completing, we’ll send the application to you via Docusign. This will allow you to complete, sign, and return it to our underwriters electronically;
- Upon review and after approval, payment of the premium.
Issuing Your Bond; Annual Renewal of the Premium
Our agency issues your Arkansas attachment surety bond and a Power of Attorney form upon payment of the premium. These items are then sent to you for signing and filing.
It will be your responsibility to see that your attachment bond is filed with the presiding court.
Additionally, your attachment surety bond is subject to annual renewal of the premium for as long as the court requires surety.
It will be your responsibility to advise our agency when your attachment bond is no longer required.
