Surety Bond; Amount and Its Purpose


As plaintiff in a civil litigation proceeding, you may be allowed by the court to seize and sequester the assets, wages, or accounts of the adverse party (that is, the defendant) prejudgment.

While this is permitted, the items seized are held by a third party, not the plaintiff.

In Florida, a condition of the garnishment bond, according to Florida statute 77.031, as amended, is that you obtain a surety bond which is twice the amount of the debt which you claim is owed.

While the surety bond is required of you as plaintiff, its benefit is for the defendant in cases where the court later determines that the garnishment was wrongly issued.

In such a determination, the harm having already been done by a wrongly issued garnishment, the surety bond guarantees that the defendant can be recompensed for the damages which have ensued.


Qualifying and the Premium


Our agency provides you with the Florida garnishment bond in the amount required of you.  Up to a $100,000 surety bond requirement, we also do so without a credit check inquiry. 

A Fl garnishment bond greater than $100,000 is subject to a further underwriter review.  This review will include a credit check inquiry.  

To be approved for a garnishment bond amount greater than $100,000, good credit is required.  You may also be asked to provide supporting documentation or information as a condition of approval.

Our agency will need the following from you in order to issue your garnishment surety bond:

  • A copy of the Florida court order stating that a garnishment surety bond is required and which provides the amount required;
  • A completed surety bond application.  Our agency typically provides this application to you via Docusign.  This will allow you to complete, sign, and return the application to our agency electronically;
  • Upon approval of your garnishment bond, payment of the premium.


Issuing Your Garnishment Bond


Our agency issues your Florida garnishment bond immediately after the premium payment has been received.

Included with your surety bond will be a Power of Attorney form.  You’ll need to sign your bond as Principal, filing both items with the presiding civil court.


Annual Renewal of Your Premium


Your Florida garnishment bond is subject to an annual renewal of the premium for as long as the court requires surety.  The premium will renew on the anniversary of your bond’s issuance
