Surety Bond; Amount and Purpose
An Iowa attachment order allows a Plaintiff, in a civil litigation proceeding, to lawfully seize the disputed property held in the possession of the Defendant, prior to a final court rendering in the case; that is, prejudgment.
While the attachment surety bond is required of the Plaintiff, its benefit is for the adverse party (namely, the Defendant) in case the court subsequently determines that the attachment order was wrongly issued.
The harm having already been caused due to a wrongly issued attachment (again, subsequently determined), the surety bond guarantees the return of the seized property and compensates for any damages caused.
According to Iowa attachment statutes, Section 639.11, as amended, the attachment bond order is no less than $250, and is in an amount double the value of the property being seized.
Qualifying and the Premium
Our agency offers the Iowa attachment bond in the amount that the court requires of you. Up to a $100,000 surety bond requirement, we also do so without a credit check. For these lower amounts, this allows for quicker processing of your surety bond request.
An Iowa attachment bond greater than $100,000 is subject to further review of a completed application by a surety bond underwriter. This review will include a credit check inquiry. To be approved for an amount greater than $100,000, good credit will also be required. And, you may also be asked to provide supporting documentation or information.
For any Iowa attachment surety bond order, our agency will need all of the following from you:
- A copy of the Iowa court order (or motion from Plaintiff’s legal counsel) stating that an attachment surety bond is required and which also states the amount required;
- A completed surety bond application. Our agency will typically send the application to you via Docusign. Docusign will allow you to electronically complete, sign, and return the application to our office electronically;
- Review of your completed application depending on the dollar amount of your surety bond;
- Upon approval of your attachment bond request, payment of the first annual premium.
Issuing Your Bond; Filing
Our agency issues your attachment bond, along with a Power of Attorney form, immediately upon receipt of the premium.
As Plaintiff, your bond will need two signatures: Ours as surety; yours as Principal. We will mail the surety bond documents to you for signing. Upon your receipt of the same, it will be your responsibility to see that your surety bond is filed with the Iowa presiding court.’
Annual Renewal of the Premium
The premium for your Iowa attachment bond is subject to annual renewals on the anniversary of your bond’s issuance for as long as the court requires surety.
Premiums paid are earned in full; there are no refunds either in whole or in part.
