Surety Bond; Amount and Purpose
An Iowa garnishment allows you as Plaintiff, in a civil litigation proceeding, to lawfully seize the disputed assets, wages, or property of the Defendant, prejudgement.
Unlike an attachment bond, which allows the seized assets to be held directly by the Plaintiff, a garnishment order allows the property to be seized and held by a third party until the final disposition of the case.
The surety bond requirement, while required of the Plaintiff, is for the benefit of “the officer” and guarantees for the latter that, pursuant to Iowa statutes 626.54, as amended, you will indemnify the officer for any damages caused as a result of the seizure or sale of the property.
Qualifying and the Premium
Our agency offers you the Iowa garnishment bond in the amount that the court requires of your. Up to a $100,000 surety bond requirement, we also do so without a credit check.
A garnishment bond greater than $100,000 is subject to review by a surety bond underwriter. This review will include a credit check inquiry, and to be approved, good credit will be required.
However, for any garnishment surety bond, our agency will need the following from you:
- A copy of the Iowa court order stating that a garnishment surety bond is required;
- A completed surety bond application. Our agency will usually send this application to you via Docusign. This will allow you to complete, sign, and return your application to our agency electronically;
- Review of your completed application as determined, in part, on the surety bond required;
- Upon approval of your application, payment of the first annual premium.
Issuing Your Bond
Our agency issues your Iowa garnishment bond upon payment of the premium. Included with your attachment surety bond will be a Power of Attorney form.
Upon receipt by mail, you’ll sign and file your bond documents with the presiding court.
Our agency will not need a copy of your filed attachment bond.
Annual Renewal of the Premium
Your Iowa garnishment surety bond is subject to annual renewal of the premium for as long as the court requires surety. The premium will renew on the anniversary of your bond’s issuance.
Premiums paid are earned in full and are nonrefundable both in part and in whole.
