Surety Bond; Purpose and Amount

 

As Plaintiff in a civil litigation proceeding (or legal counsel for the same), the court is allowing you to seize the assets or property of the adverse party (i.e. the Defendant) --- prejudgment --- provided that you obtain an attachment surety bond in the amount required.

According to Kansas statutes, Chapter 60, Article 7, 60-705, as amended, the amount of the surety bond required must be twice the value of the amount claimed.  A lesser amount is permissible by order of the presiding judge.

While required of you, the attachment surety bond is for the benefit of the Defendant in case the court subsequently determines that the attachment order was wrongly issued. 

In such a determination, the surety bond would potentially compensate the adverse party due to the deleterious effects of a wrongly issued attachment order.

 

Qualifying and the Premium

 

Our agency offers you the Kansas attachment bond in the amount required.  Up to a $100,000 surety bond requirement, we also do so without a credit check inquiry.  

An writ of attachment order greater than $100,000 will be subject to further review of your completed application by a surety bond underwriter.  This review will include the determination of “good credit” as a condition of approval.

But, for any attachment order our agency will need the following from you:

  • A copy of the Kansas court order stating that an attachment surety bond is required.  This order is necessary because, besides providing our agency with proof of the surety requirement, the order will give us everything needed to form an acceptable surety bond for you;
  • A completed application from you.  We’ll send you the application via Docusign.  This will allow you to complete, sign, and return your application to our agency/the underwriters electronically;
  • Upon approval, payment of the premium.

 

Issuing Your Attachment Bond

 

Your Kansas plaintiff's attachment bond and a Power of Attorney form are sent to you upon payment of the premium.  

It will be your responsibility to sign your bond as Principal, and see to it that your bond and POA are filed in a timely manner with the presiding court.

Our agency does not need a copy of your issued surety bond.

 

Annual Renewal of the Premium

 

Your attachment order surety bond is subject to annual renewal of the premium for as long as the court requires surety.  The renewal will be due no later than the anniversary of your bond’s issuance.

Premiums paid are earned in full.
