Surety Bond; Purpose and Amount


A Michigan attachment bond may alternately be referred to as a ‘Michigan writ of attachment bond’ or a ‘Michigan plaintiff’s attachment bond’.  

As noted, the surety bond is required of a plaintiff in a civil litigation proceeding.

Once the court-ordered attachment surety bond requirement is met, the plaintiff is permitted to seize the disputed assets or property of the defendant, pre-judgment; that is, prior to the court making a final decision in the underlying case.

Why is an attachment surety bond required?

The purpose of the Michigan attachment bond is to protect the defendant from the loss or harm caused if the court subsequently determines that the attachment should not have been ordered.

According to Michigan Court Rules, Chapter 3 Special Proceedings and Actions, as amended, the bond amount should be twice the value of the amount alleged in the complaint.


Qualifying and the Premium


Our agency offers the Michigan writ of attachment bond up to a $100,000 surety bond requirement without a credit check.  

Higher attachments amounts require a further underwriter review of your application.  This review will include a credit check inquiry.  To be approved, good credit will be required. 

For our agency to issue an attachment bond, regardless of the amount, we’ll need the following from you:

  • A copy of the Michigan court order stating that an attachment bond is required.  This order will essentially provide us with all of the items needed to issue your bond correctly;
  • A completed surety bond application.  Our agency will usually provide this application to you via Docusign.  This will allow you to complete, sign, and return your application to our agency electronically;
  • Review or automatic approval based on the surety bond amount required as discussed above;
  • Payment of the premium.


Issuing Your Attachment Bond


Upon receipt of the premium, our agency issues your attachment bond and a Power of Attorney form for you to sign.

Upon receipt, after signing your bond, you or legal counsel will need to ensure that the bond documents are filed with the presiding court; our agency will not need a copy of the completed bonds.


Annual Renewal of the Premium


The premium for your attachment surety bond is subject to annual renewals for as long as the court requires surety.  The premium due date will be the date on which your bond is issued.

Premiums paid are earned in full and are not subject to refunds either in whole or in part.
