Surety Bond; Amount and Purpose
An attachment order allows you as Plaintiff, in a civil litigation proceeding, to seize and take possession of the disputed asset(s) of the Defendant. This concession is offered to you, before the final disposition of your case — that is, prejudgment — conditioned upon your obtaining an attachment surety bond as required by Oklahoma law.
In Oklahoma, according to Statute §12-1153, as amended, the amount of the surety bond shall be no less than twice the amount of your claim.
While required of you as the Plaintiff, or for legal counsel, your client, the Oklahoma attachment surety bond serves as a financial guarantee for the Defendant in case the court subsequently determines that the attachment order was wrongly issued.
In such a determination, the Defendant would be able to be compensated for the loss and harm caused by a wrongfully issued Oklahoma attachment order; the surety bond is a pledge of this compensatory guarantee.
Qualifying and the Premium
Our agency offers you the Oklahoma plaintiff’s attachment bond up to a $100,000 surety bond requirement without a credit check.
An attachment surety bond requirement greater than $100,000 is reviewed by a surety bond underwriter before approval is granted. There is also a credit review. Approval is conditioned upon, in part, having good credit.
But for any attachment bond request, our agency will need the following from you:
- A copy of the court order or the affidavit stating that an attachment surety bond is required;
- Completion by you of a Docusign application. This will allow you to complete, sign, and return the completed application to our agency electronically;
- Review of your completed application;
- Upon approval, payment of the first annual premium.
Issuing Your Attachment Bond
Our agency issues your OK writ of attachment surety bond immediately upon payment of the premium. Your surety bond and a Power of Attorney form are sent to you for signing.
Upon receipt, you’ll sign your bond as Principal. It will thereafter be your responsibility to see that it is filed with the presiding court.
Annual Renewal of the Premium
The premium associated with your Oklahoma attachment bond is subject to annual renewals for as long as the court requires surety.
Premiums paid are earned in full.
