Our minimum surety bond requirement to entertain a Texas attachment bond is $50,000.

Surety Bond:  Amount and Its Purpose


As plaintiff in a Texas civil litigation proceeding, the court may allow you to seize the disputed property of the adverse party (that is, the defendant), prejudgment.

A condition of doing so is that you obtain a court-ordered writ of attachment surety bond.

According to Texas statute (i.e. Rule 592 - Application for Writ of Attachment and Order, Tex. R. Civ. P. 592 ), as amended, the amount of the court ordered surety bond will be left to the discretion of the court; however, this amount will be determined by the court’s estimation of the damage sustained by the defendant should you unsuccessfully prosecute your case.

And that brings us to the purpose of this surety bond.

While the writ of attachment (aka ‘attachment bond’ or ‘plaintiff’s attachment bond’) is required of you, its benefit is for the defendant in case the court subsequently determines that the attachment bond was wrongly issued.

In such a determination, the defendant would be able to be compensated for the loss and harm caused by a wrongly issued attachment order.


Qualifying and the Premium


Our agency offers you the Texas writ of attachment bond up to a $100,000 surety bond amount without a credit check inquiry.

An attachment order greater than $100,000, if applicable, is subject to review of your application by a surety bond underwriter.  This review will include a credit check; and, to be sure, good credit is required for approval.

For an amount greater than $100,000, you may also be asked to provide supporting information or documentation as a condition of approval.

For any attachment surety bond, our agency will need the following from you:

  • A copy of the Texas court order stating that a writ of attachment surety bond is required of you;
  • Completion of a surety bond application.  The application can be sent to you via Docusign which will allow you to complete, sign, and return the application to us electronically;
  • Review of your application by a surety bond underwriting, depending on the amount required;
  • Upon approval of your application, payment of the first annual premium.


Issuing Your Attachment Bond


Once the premium for your surety bond is paid, our agency issues your TX writ of attachment bond.  Included with your surety bond will be a Power of Attorney form. 

These items will be mailed to you for signing as Principal.  It will then be your responsibility to see that they are filed with the presiding Texas litigation court.


Annual Renewal of the Premium


The premium for your writ of attachment bond is subject to annual renewals of the anniversary of your bond’s issuance for as long as the court requires surety.

Premium paid are earned in full and are completely and even partly nonrefundable.
