Surety Bond; Amount and Purpose


An attachment order allows a Plaintiff, prejudgment, in a civil case, to seize and take possession of the disputed property held by a Defendant.

A condition of the attachment order going into effect is that the Plaintiff provides the court with an attachment surety bond.

In West Virginia, according to statute §38-7-8, as amended, the amount of the attachment bond must be at least twice the value of the property which is being attached.  The court will typically stipulate the exact amount of surety bond required of you.

While required of you as Plaintiff, (or for legal counsel, your client), the attachment surety bond is a financial guarantee on behalf of the Defendant, in case the court subsequently determines that the attachment order should not have been issued.  

The attachment surety bond could potentially serve as a means to remedy the harm caused to the Defendant by a wrongfully issued attachment order. 


Qualifying and the Premium


Our agency offers you the West Virginia attachment bond in the amount that the court requires of you.  

Up to a $100,000 surety bond requirement, we also do so without a credit check inquiry.  For an amount greater than $100,000, approval is subject to an underwriter review which includes the requirement of a determination of “good credit”.

For any attachment surety bond amount, our agency will need the following from you:

  • A copy of the court order which states that a West Virginia attachment bond is required, as also the amount of the attachment. In lieu of a court order, a letter from legal counsel which provides all of the same information to be found on a court order will be sufficient;
  • Completion of a surety bond application.  We will typically provide the application to you via Docusign.  Docusign will allow you to complete, sign, and return your application to us electronically;
  • Review of your completed application;
  • Upon approval, payment of the premium.


Issuing Your Bond


Our agency issues your West Virginia attachment bond along with a Power of Attorney immediately upon payment of the premium.  

These items will be mailed to you.  It is your responsibility to both sign and file your bond with the presiding court.


Annual Renewal of the Premium


The premium associated with your West Virginia attachment bond is subject to annual renewals on the anniversary of your bond’s issuance for as long as the court requires surety.

Premiums paid are earned in full.
