Surety Bond Writ of Attachment; Purpose and Amount
An attachment order allows you, or for legal counsel, your Plaintiff client, to seize and take possession of the disputed property of the Defendant in civil litigation, prejudgement.
A condition of the attachment order taking effect is that the Plaintiff obtains a ‘writ of attachment bond’ (which can alternately be referred to as a ‘plaintiff’s attachment bond’, or an ‘attachment bond’) in the amount ordered by the Wisconsin court.
This surety bond requirement is in accordance with Wisconsin statute §811.06, as amended.
While required of the Plaintiff, the attachment order protects from the harm and loss caused by an attachment order in cases where the court subsequently determines that the attachment should not have been issued.
Qualifying and the Premium
Our agency offers you the Wisconsin writ of attachment surety bond up to a $100,000 requirement without a credit check.
An attachment bond order greater than $100,000 is subject to the determination of good credit and other factors as determined by a surety bond underwriter.
For any attachment bond, our agency will need the following from you:
- A copy of the Wisconsin court order stating that an attachment surety bond is required and which states the amount of the bond;
- A completed surety bond application. The application can be sent to you via Docusign. Docusign facilitates the electronic completing, signing, and returning of a surety bond application;
- Review of your completed application.
- Upon approval, payment of the premium.
Our agency issues your Wisconsin writ of attachment bond to you immediately upon payment of the premium.
Your bond, along with a Power of Attorney form are mailed to you by our agency. It will be your duty to see that as Plaintiff, you sign and have filed your attachment bond in a timely manner with the presiding court.
Annual Renewal of Wisconsin Writ of Attachment Bond
The premium for your Wisconsin writ of attachment bond is subject to annual renewals for as long as the court requires surety. The renewal date is the anniversary date of your bond’s issuance.
Premiums paid are earned in full. Refunds, in whole or in part, are not offered.
